Terms and conditions
Cheer for the Winner, (hereinafter referred to as the "Quiz") is being organized by Vivo Mobile India Pvt. Ltd. (hereinafter referred to as the "Vivo ") from 23rd March till 29th March 2019.
Description of the game:-
Guess the answers of the mentioned questions, the participant who answers all the questions correctly will be eligible to win Bluetooth earphones.
Rules of game:-
- Users can submit their answers from 00:00 hrs (12 A.M. midnight) to 19:00 hrs (7 P.M.) every day.
- The quiz is available from 23rd March to 29th March 2019.
- Every day each participant will get only one chance to play the quiz.
- Every day three lucky winners will stand a chance to win Bluetooth earphones.
- The prizes will be shipped post 10 days after the completion of the offer.
Prizes:-
- Everyday three lucky winners will stand a chance to win Bluetooth Earphone.
- The winners will be announced after the completion of the quiz.
General Terms and Conditions:-
1. The Game / Prize Draw is open to all people who is legal resident of the Republic of India, should be of an age 18 years or above at the time of entry into the Game.
2. This game can only be played in mobile and tablets.
3. Participant must have valid, registered and active email ID and have a billing address within the territory of India.
4. Employees of vivo India or their family members, or anyone else connected with the game are not eligible to win the listed prizes.
5. Participants who participate into the Game shall be deemed to have accepted these Terms and Conditions.
6. By submitting your personal information you agree to receive emails from vivo India containing offers and developments that we think may interest you. You will be given the opportunity to unsubscribe on every email that we send.
7. To enter the game you must completely fill the login details. You should be an individual legal resident of the Republic of India;
8. The winners will be notified by email / phone and must provide a postal address to claim their prize (if required). If a winner does not respond to vivo India within 14 days of being notified by vivo India, then the winner's prize will be forfeited.
9. The winners will be contacted post 10 days post the completion of the quiz.
10. The prize will be sent to the winner by vivo India by post / courier.
11. The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes.
12. Vivo India retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available.
13. The winner may be required to take part in promotional activity related to the Game and the winner shall participate in such activity on vivo Mobile India reasonable request. The winner consents to the use by vivo Mobile India and its related companies, both before and after the closing date of the Prize Draw for an unlimited time, of the winner's voice, image, photograph and name for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by vivo India and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Game, all entrants consent to the same.
14. Vivo India shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen here, and in accordance with data protection legislation. By entering the Game, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Game entry.
15. Vivo India accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Game or accepting the prize. Vivo India further disclaims liability for any injury or damage to your or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Game. Nothing in these Terms and Conditions shall exclude the liability of vivo India for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
16. The Game is available only in select cities of India and is valid only for Indian citizens. This Game is not applicable in places wherever prohibited and / or on rewards / services for which such offers cannot be made available for any reason whatsoever. For the avoidance of doubt, it is hereby clarified that this game is not applicable to the Participants in the state of Tamil Nadu.
17. Vivo India reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Game with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of vivo India in all matters under its control is final and binding and no correspondence will beventered into.
18. Vivo Mobile India shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
19. All disputes relating to this the Game will be governed by the Indian law and t shall be subject to the exclusive jurisdiction of the Courts at New Delhi only
20. In the event of a death of the prize winner, no claim from the nominees or legal heirs of the prize winner will be entertained for receiving the prize.
21. No cash payment will be made in lieu of the prizes.
22. Vivo Mobile India shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.
23. The participant waives conditions of DND register by participating in the promotion.
24. Vivo Mobile India reserves the right, at any time, to verify the validity of entries and participants (including a participant’s identity, age and place of residence) and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.
25. There is no entry fee and no purchase necessary to participate in the game.
26. Participants are not bound in any way to participate in this game. Any participation is voluntary and the game is being made purely on a best effort basis.
27. The game shall be subject to the Income Tax Act, 1961 and all disbursement shall be subject to TDS, as applicable, if any.
28. The Participants agree to be bound by the terms and conditions contained herein. Without a Participants being required to do any further act, the Customers shall be deemed to have read, understood and unconditionally accepted the terms and conditions herein.
